Terms of Service
1. Scope and Provider
These terms of service govern the use of the mobile application "Gennady" (the "App") and the website gennady.xyz. The provider is TopieT GmbH, Giesenheide 40, 40724 Hilden, Germany, registered in the commercial register of the local court (Amtsgericht) Wuppertal under HRB 29871, represented by Igor Shelkovenkov (the "Provider"). The App is aimed at consumers. Users of the paid offering must be of legal age. The App is intended for use by children under the supervision and with the consent of their parents or guardians.
2. Description of Services
Gennady is a homework help app for primary school children. The App in particular enables: scanning worksheets, AI-supported child-friendly explanations of tasks, checking answers (by voice, text or photo), a read-aloud feature and a reward system. The exact feature set follows from the current App description in the App Store.
The Provider strives to keep the App continuously available but does not owe uninterrupted availability. Maintenance, further development or disruptions may lead to temporary restrictions.
3. Registration and Account
A user account is required to use the App. Registration takes place in the App, including via Apple Sign-In or email. A guest mode with limited retention is available. Data provided during registration must be accurate.
Login credentials must be kept confidential. Sensitive actions in the App (such as purchases or account settings) are protected by an adult confirmation step (parental gate). The account can be deleted in the App at any time.
4. Prices, Subscription and Purchase via Apple
The App can be downloaded free of charge and tested for a limited time. The full feature set requires a paid subscription. The subscription is concluded exclusively as an in-app purchase via the Apple App Store. Apple is the contracting party for the purchase process and payment handling; the Apple Media Services terms and conditions apply in addition.
The applicable prices and terms are displayed in the App and in the App Store before purchase. The subscription renews automatically unless it is cancelled in the Apple account settings before the end of the current period.
Apple’s rules apply to withdrawal and refunds for in-app purchases. Refund requests must be submitted via Apple (reportaproblem.apple.com). Statutory consumer rights remain unaffected.
5. User Obligations
Users undertake to use the App only as intended, not to upload unlawful content and not to take actions that impair the functionality of the App. In particular, no content that infringes third-party rights may be transmitted via the scan and chat features.
Parents and guardians are responsible for supervising their child’s use of the App and for granting the required consents.
6. AI Notice
The explanations and answer checks in the App are created with the help of artificial intelligence. Despite careful design, AI-generated content may contain errors or inaccuracies. The App is a supporting learning aid; it does not replace school lessons, professional tutoring or pedagogical or therapeutic advice.
Parents are advised to review their child’s learning results occasionally and to consult teachers in case of uncertainty.
7. Liability
The Provider is liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health. In cases of simple negligence, the Provider is only liable for breaches of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract.
No liability is assumed for the correctness of individual AI-generated explanations in the sense of a guarantee of learning outcomes. Liability under the German Product Liability Act remains unaffected.
8. Term and Termination
The user agreement runs for an indefinite period and can be terminated by users at any time by deleting the account. The subscription is cancelled in the Apple account settings and ends when the paid period expires.
The Provider may terminate the agreement for cause and block access in the event of significant violations of these terms.
9. Changes to These Terms
The Provider may amend these terms with effect for the future where required due to changes in the law, case law or further development of the App, provided users are not unreasonably disadvantaged. Significant changes will be announced in the App or on the website.
10. Applicable Law and Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of mandatory consumer protection provisions of the state of their habitual residence.
Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
